CONDITIONS OF SALE This is a free translation and only the German version has legal force All bidders agree to the conditions of sale as stated below 1 Jan K Kube e K Auctioneer acts as a commissioner for unnamed consignors All business and all invoices are in EURO only 2 All lots can be examined at our place in SUGENHEIM Castle the week before the sale also 2 hours on sales day before sale starts It is not possible to send lots for examination to prospective bidders All lots are sold as is with all faults imperfections and errors of description Prospective bidders submitting written order bids may file complaints within six weeks after the sale however this does not entitle them to delay final payment of our invoice Catalogue descriptions are made as conscientiously as possible nevertheless no descriptions shall be deemed as a warranty 3 The Auctioneer reserves the right to withdraw separate combine or rearrange any lot without giving a reason 4 Order bids will be handled carefully without any extra charge however without warranty Bids marked best price or in any case will not be accepted Please note a definite maximum bid price on your order bid Please be informed that only the lot number is valid on your order bid all error is on bidder s risk Also misunderstandings resulting from phone calls telegrams telexes or fax letters are at the bidder s risk 5 You can bid by order bid postal letter or fax in person at the sale room or by phone If bidding live by phone please send a fax letter 24 hours before sale date latest note the lot you want to bid by phone and sign it We will call you during the sale please be informed that we do about 300 lots per hour We don t accept bids by e mail Payment is due immediately in EURO and in cash Checks are only accepted on special arrangement prior to the sale and must cover the total amount due including all costs for necessary packing mailing insurance and all bank charges Payment is also posssible and prefered by bank transfer to our account free of any charges for the Auctioneer Any overpayment will be credited or refunded if checks or bank transfers do not cover full amount of invoice the Auction eer will ask for final payment before mailing bought lots Foreign customers bidding by mail or phone must pay within 10 days after the receipt of the invoice We don t accept credit cards A buyer acting for a third party may be held responsible as well as the third party in whose name the invoice is made out or has not made a sufficient deposit prior to the auction If in doubt please call the Auctioneer Identical 6 With the fall of the hammer a lot is won by the highest bidder However the Auctioneer may refuse and bid submitted in person or by letter if said bidder is unknown to him does not have a satisfactory reference bids will be decided by drawing lots Bidding may be renewed in any case of error or dispute 7 The succesful bidder is obliged to take and pay for the won lot From then on the succesful bidder bears all risks for won lots however until full payment the lot remains the property of the Auctioneer Commission is 23 on top of the hammer price including V A T The V A T is not refundable also not for customers outside Germany Payment is due immediately in cash and only in EURO Checks are only accepted on special arrangement prior to the sale and must cover the total amount due and all bank charges We don t accept credit cards If invoice is sent to a postal bidder it includes our charges for packing mailing and insurances Check made out for our invoice must cover also all banking charges for clearing Payment of postal bidders can also be arrangend by bank transfer to our account free of any charges for the Auctioneer Overpayments will be credited or on request refunded If payments do not cover amount due and clearing charges the Auctioneer will ask for final payment before mailing out goods Foreign customers bidding by mail must pay within 10 days after receipt of invoice A buyer acting for a third party may be held responsible as well as the third party in whose name the invoice is made out 8 It is understood that invoices issued during or immediately after the sale are subject to confirmation and may sub sequently require correction 9 All consignments are made at the buyer s risk and expense In case of shipping damage or loss the buyer is obliged to file claim with the post office or shipping agents If the buyer fails to do so the insurance company cannot be held responsible for the loss 10 Jan K Kube e K Auctioneer reserves the right of excluding any person from the auction without explanation 11 Accepted phone bidder s do automatically bid for minimum price of the lot 12 No lot may be claimed until paid in full Late payment may be subject to a 2 surcharge and in addition legal interests can also be demanded 13 All forgoing conditions are also valid if buying unsold lots after the sale 14 Place of jurisdiction for all parties is Munich Germany
