Agency Conditions Booking of hotel and private rooms as well as holiday apartments and houses is effected by the reservation service of Celle Tourismus und Marketing GmbH Celle Tourismus und Marketing GmbH is neither the tour operator in accordance with 651a ff BGB nor a party to the respective travel or hospitality contract The latter is entered into directly with the renters Celle Tourismus und Marketing GmbH assumes liability for its agency services only Liability is limited to intent and gross negligence Court of jurisdiction is Celle 22 23 5 2 Cancellation Costs In any event of cancellation on your part not due to default on our part the following cancellation costs apply up to 43 days before tour departure 10 of tour price from the 42nd up to the 29th day before tour departure 40 of tour price from the 28th up to the 7th day before tour departure 50 of tour price from the 6th day up to one day before tour departure 80 of tour price In the event of cancellation the traveller is permitted to provide evidence of lower damage or no damage incurred by us with reference to the cancellation costs charged by us 5 3 In the event of any changes in booking we generally reserve the right in the event of cancellation on your part to charge you for any costs we may be invoiced for by any relevant third party plus a handling fee For any changes in booking up to 30 days before departure the charge is 25 00 per person except all inclusive bookings 50 00 5 4 Further cancellation on our part due to extraordinary circumstances is possible in the event that performance of the tour is hampered endangered or impaired due to extraordinary circumstances e g strike natural disasters force majeure and suchlike not foreseeable at the time of contract formation 6 Liability 6 1 Within the scope of a prudent businessman s due diligence we assume liability for diligent tour preparation diligent selection of service providers correctness of description of the tour services listed in the brochure and adequate provision of contractually agreed tour services 6 2 We assume liability in the event of default on the part of the person entrusted with service provision Our liability is limited in accordance with Item 6 3 6 3 Our liability as stipulated by travel contract for damages which are not physical damages is limited to three times the amount of the tour price in the event that damage incurred by the traveller has not been caused intentionally or due to gross negligence or in the event that we are solely liable for damage incurred by the traveller due to default on the part of a service provider 6 4 Any claim for compensation against us is excluded or limited in the event that due to national or foreign regulations which are applicable to the services to be provided by a service provider the latter s liability is also excluded or limited 6 5 We assume no liability for any disruption of services in the domain of third party services for which we merely provide agency services In any such events it is not we who are liable for provision of carriage services but the carrier 6 6 Any liability for damages incurred due to delays is excluded 7 Warranty 7 1 In the event of any disruption of services each traveller is obligated to make every reasonable effort to contribute towards remedying the disruption and to keep any possibly resulting damage as low as possible In the unexpected event that you have reason for complaint any such complaint must be registered with the courier In the event that there is no local courier or local agency in charge or the latter are unable to remedy a disruption of service you are requested to address the service provider hotel owner etc as well as us in the event that we are the service provider You agents are not permitted to recognize any kind of claims 8 Exclusion of Claims Lapse of Claims 8 1 In compliance with 651g BGB you must register any possible claims with us or with the relevant operator or service provider within one month after contractually agreed end date of tour In your own interest such registration should be effected in writing and by registered post 8 2 Your claims due to non contractual provision of tour lapse after twelve months The statutory limitation period begins on the days the tour was supposed to end according to contract 9 Passport Visa Duty Currency and Health Regulations The traveller is personally responsible for compliance with any passport visa duty currency and health regulations 10 Any and all disadvantages arising from non compliance with these regulations are at the expense of the traveller even in the event that such regulations are changed after booking of the relevant tour 11 General Stipulations 11 1 Correction of errors including misprints and calculations errors reserved All details provided correspond to the situation at the time of going to print 11 2 The invalidity of any individual stipulations of the travel contract does
