und Marketing GmbH as the tour operator in accordance with 651a ff BGB and do not apply in the event of mere agency services for hotel and private rooms as well as holiday apartments and houses by means of the booking service of Celle Tourismus und Marketing GmbH Concerning the aforementioned mere agency services we explicitly refer to our agency conditions 1 Registration Confirmation of Booking 1 1 By registering with us your intention to book a tour you make a binding off er to us to enter into the travel contract Such registration can be made in writing or by telephone 1 2 The registering party and the participants are jointly and severally liable for fulfilling the obligation of the person registered by that party 1 3 To us subject to the provisions below the tour operator contract only becomes binding regarding price if we have confirmed to you the booking and the tour price in writing 1 4 In the event that the content of the booking confirmation differs from the content of the registration the differing content in the booking confi rmation becomes binding for the traveller and for us if you do not make use of the possibility of cancellation offered within 10 days 2 Payment 2 1 Payments towards the travel price before the tour may be demanded and accepted only in exchange for the secured payment certificate in accordance with 651 k BGB The secured payment certificate is sent or handed to you together with the booking confirmation invoice 2 2 Payment to the amount of 100 of the travel price must be made to the business account indicated no later than 21 days before the agreed date of arrival 3 Services and Prices 3 1 The extent of contractual services arises from the description of services in the brochure or from the details in the booking confirmation 3 2 The traveller has no right of reimbursement In the event that the traveller does not make use of any individual travel services due to early departure or for any other important reason we shall endeavour to arrange reimbursement of the saved expenditure with the service provider No compensation will be made in the event that any official legal or tariff regulations exclude such reimbursement or in the event that the service not made use of is negligible We reserve the right to retain 20 minimum 25 00 of the amount reimbursed as a handling fee 4 Changes to Services and Prices 4 1 In the event that substantial services cannot be provided we shall notify you without commitment of any such changes to the extent possible and in the event that the changes are not merely negligible 4 2 Any case of non conformity of any individual travel services with the contractually agreed content of the travel contract that arises after contract formation and which is not due to any breach of good faith on the part of the tour operator is permitted to the extent that such non conformity is not substantial and does not compromise the overall character of the travel booked The changed service replaces the service originally due by contract 4 3 We reserve the right to accordingly raise the agreed price in the event of any raise of carriage charges or charges for specific services such as port or airport charges or any change to the currency exchange rates relevant to the booked travel Such price raise is only permitted in the event that there is a period of more than 4 months between contract formation and the agreed travel date and the circumstances leading to the price raise have not occurred at the time of contract formation and were not foreseeable by us at the time of contract formation In the event of any subsequent change of the travel price we shall im mediately notify you of the relevant details for calculation of the new travel price Any price raises from the 20th day before departure are non effective In the event of any price raises by more than 5 you have the right to withdraw from the travel contract without charge or to demand participation in a tour of at least the same value in the event that we are able to off er you any such tour from our range of offers without extra cost to you Assertion of these rights must be made immediately upon being notified of the price raise 5 Cancellation by the Customer 5 1 You can cancel the tour at any time In your own interest and to avoid any misunderstandings we strongly recommend
